This privacy notice for Herd ('Company', 'we', 'us', or 'our'), describes how and why we might collect, store, use, and/or share ('process') your information when you use the Herd platform ('Services').

What Data Do We Collect?

We don’t receive any personal data about you other than what you provide us with when you your register for a Herd account, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Herd platform, or when you contact us. 


Personal information provided by you: 


The personal information that we collect depends on the context of your interactions with us, the choices you make, and the products and features you use. 

When you sign-up to hear about Herd, create a Herd account, or register for an event or masterclass we’ll collect the following details: 

First name

Surname
Email address

Password

Profile picture
Location

Phone number

Information from direct messages and posts on the Herd platform

Information you provide us with when you contact the Herd team.


Sensitive Information:

We do not collect sensitive information. We’d recommend that you don’t disclose anything of a sensitive nature when using the Herd platform or attending an online or in-person event. 


Payment Data:

We may collect payment data through third parties to process a payment for the Herd platform or to attend an online or in-person event. This will include details such as your full name, email address and postal address.


Information automatically collected:

We automatically collect certain information when you visit, use, or navigate the Herd platform. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of the Herd platform, and for our internal analytics and reporting purposes. 


Log and Usage Data. 

Log and usage data is service-related information to allow us to understand the usage and performance of the platform. Depending on how you interact with us, this data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings). 


Device Data: 

We collect device data such as information about your computer, phone, tablet, or other device you use to access our Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information. 


Location Data. 

We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services. 


Are we doing any automated decision making?

To help you use Herd and our Services more effectively, we may employ machine learning and other analytics that make inferences about some characteristics of our users. We may use these tools to tailor emails to you, to show and prioritise events and masterclasses to you based on your Herd profile, what we think you’ll be interested in, and how you interact with the Herd platform. 


On what Legal Bases do we process your data?

We process your personal data on a variety of legal bases depending on the use. For example:


Contract Performance: 

We use your information to manage your account, your use of our Services and the relationship you have with us. Failure to provide this information means that may not be able to join or use the Herd platform. We’ll also notify you by email of new features or changes to your Herd account and important alerts such as outages or security issues. 


Consent:

We will only process your personal data to send you direct marketing communications if we have your consent and you can withdraw this consent at any time by clicking on the unsubscribe link at the bottom of the email. 


Legal Obligation: 

Sometimes it is necessary to process your data for us to comply with our legal obligations to prevent activities such as fraud and to assist law enforcement. 


Legitimate Interest: 

We’re allowed to use your information where, on balance, the benefits of us doing so are legitimate and not outweighed by your interests or legal rights. For example, we have an interest in knowing how well our products, marketing activities and business processes are working so we can provide a better experience for our users. We will also send you emails about your Herd profile, daily updates, upcoming events, and masterclasses. You can unsubscribe from these emails at any time by clicking on the unsubscribe link at the bottom of the email. 


Children’s Data

We do not direct our Services to people under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with personal data, please get in contact with us. 


What happens if you don’t want us to have your data?

You are not required to provide personal data to us. However, your failure to do so may affect our ability to provide the Services you request. For example, we are unable to give you access to the Herd Platform if you do not provide us with your email address. 

 

Who do we share your data with?

We may disclose your data to our affiliated organisations and subsidiaries, and to service providers who render services to us or you on our behalf. We also may disclose your information if required by law, requested by law enforcement authorities or to enforce our legal rights. 


Our service providers include:


  • Our platform provider – to interact with the Herd community through discussions, posts and direct messages
  • Video conferencing platforms to provide online events and masterclasses
  • Banks and payment providers - to authorise and complete payment transactions
  • Physical events - to provide in-person meet-ups
  • Organisations within the payment card industry - to help prevent online fraud
  • IT, information security and cloud services providers – to help us provide the Services and keep your data safe;
  • Communication providers – to assist us with the processing and delivery of email and other communications;
  • Behavioural analytics tools, to collect and help us understand data when you use our Services. 

 

Where are we sending your data?

We may store your personal data outside the UK or EU. If we do, your data will be processed only in countries that provide an adequate level of protection for personal detail and where the recipient provides appropriate safeguards, such as model contract clauses, binding corporate rules, or a certification scheme. 


How long do we keep your data for?

We keep your personal data for as long as we have a legitimate reason to use the data and as required by law.


What Are Your Rights?

Herd recognises that your personal data belongs to you, and we don’t wish to use it in ways that you don’t want us to.

If granted by applicable laws, you can also exercise a variety of rights regarding our use of your data:

  • You can ask us for a copy of the information we have about you
  • You can ask us to correct any incorrect data we have about you and you can also update your account details in the Herd platform
  • You can ask us to delete your data
  • You can ask for your data in a common, machine-readable format
  • You can object to any processing we do on the basis of legitimate interests or to any automated decision-making
  • You can ask us to restrict the processing of your data

To exercise any of the foregoing rights, please get in contact with us. Note that some of these rights may not be enforceable in your jurisdiction and some aren’t absolute. We will respond to your request within one month of receiving it. Also, note that if you’re located in the UK or the EU, you have the right to lodge a complaint with the UK Information Commissioner’s Office or the supervisory authority in your country of residence or place of work. 


How do we notify you of changes to this Policy?

We keep this Policy under regular review and place updates on the Herd platform. We may also provide notifications of material changes via email or other channels. If you keep using the Services after we notify you, you consent to the updated Privacy Policy. If not, you may cancel your account.
